Throughout these Terms, the following definitions apply:

- "Customer", "You", "Your" refers to the person or entity purchasing containers from us.
- "Container" refers to any shipping container, including new, used, modified, or specialized containers offered for sale.

- "Services" includes container sales, delivery, modifications, and related offerings.
3. Container Listings and Pricing
3.1 Product Descriptions
We strive to ensure all container descriptions, specifications, images, and pricing on our website are accurate and up-to-date. However, we do not warrant that product descriptions or other content are error-free, complete, or current. Container conditions (such as "new", "used", "wind and water tight", etc.) are described to the best of our knowledge based on industry standards.
3.2 Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated. We reserve the right to change prices at any time without prior notice. While we make every effort to ensure accurate pricing, errors may occasionally occur. If we discover an error in the price of a container you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.
3.3 Availability
Container availability is subject to change without notice. All containers are offered subject to prior sale. We will notify you if a container you have ordered becomes unavailable and provide suitable alternatives or a full refund.
4. Orders and Payment
4.1 Order Process
When you place an order through our website, you are making an offer to purchase containers subject to these Terms. We will send you an order confirmation email acknowledging receipt of your order. This does not constitute acceptance of your order. A contract between us will only be formed when we send you a separate email confirming dispatch of your container(s) or when payment has been processed and accepted.
4.2 Payment Methods
We accept the following payment methods:
- Credit Card (Visa, Mastercard, American Express)
- Direct Bank Transfer / EFT
- Bank Cheque
- Cash (for in-person pickups only)
- Finance options (subject to approval)
4.3 Deposits
For certain orders, particularly modified containers or special orders, we may require a non-refundable deposit of up to 50% before commencing work. The balance must be paid in full prior to delivery or collection.
4.4 GST
As a registered Australian business, we are required to charge GST on all taxable supplies. A tax invoice will be provided with your order confirmation.
5. Delivery and Collection
5.1 Delivery Areas
We deliver shipping containers to all major metropolitan and regional areas across Australia. Delivery to remote or difficult-to-access locations may incur additional charges, which will be quoted prior to order confirmation.
5.2 Delivery Costs
Delivery costs are calculated based on your location, container size, and access requirements. You will be provided with a delivery quote before confirming your order. Delivery is not included in container prices unless expressly stated.
5.3 Delivery Responsibilities
The customer is responsible for ensuring:
- Safe and adequate access for the delivery truck (minimum 4.5m width, 5.5m height clearance)
- A solid, level ground surface for container placement
- No overhead obstructions (power lines, trees, etc.)
- Any necessary council permits or approvals are obtained
- Someone is present to accept delivery during the agreed time slot
5.4 Failed Deliveries
If delivery cannot be completed due to inadequate access, incorrect information provided, or no one being present to accept delivery, additional fees may apply for re-delivery attempts. These fees will be charged at our standard rates.
5.5 Collection
Customers may arrange to collect containers from our depot by appointment. All collection must be completed within 7 days of payment clearance. Storage fees may apply for containers left beyond this period.
6. Inspection and Acceptance
For used containers, it is the customer's responsibility to inspect the container prior to acceptance or delivery. We encourage customers to personally inspect containers at our depot before purchase. For deliveries, you must inspect the container upon arrival before the truck departs.
Once you sign the delivery docket or acceptance form, you acknowledge that you have inspected the container and accept it in its current condition, subject to any noted exceptions. Claims for damage or discrepancies must be noted on the delivery documentation at the time of delivery.
7. Warranty and Returns
7.1 Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
7.2 Container Warranty
We provide the following warranties:

7.3 Warranty Exclusions
Warranties do not cover:
- Normal wear and tear
- Damage caused by improper use, neglect, or accidents
- Rust forming on cut edges or weld points on modified containers
- Cosmetic issues on used containers (dents, scratches, surface rust)
- Damage caused by relocation or improper ground preparation
- Containers used for purposes other than storage
7.4 Returns and Refunds
Returns are accepted within 14 days of delivery only if the container is significantly different from its description. Return shipping costs are the responsibility of the customer unless the return is due to our error. Custom-built or modified containers cannot be returned unless faulty.
8. Limitation of Liability
To the maximum extent permitted by law, Aussie General Freight Pty Ltd excludes all liability for any loss or damage (including indirect, special, or consequential loss) arising from the use of, or inability to use, our containers or website, or from any action taken (or not taken) as a result of using this website or any information contained within it.
Where liability cannot be excluded, our maximum liability is limited to, at our option, replacing or repairing the container, or refunding the purchase price.
We are not liable for any loss of contents stored in containers, business interruption, or any other consequential losses.
9. Customer Responsibilities
As a customer, you agree to:
- Provide accurate and complete information when ordering
- Ensure you have the legal right to place a container on your property
- Comply with all local council regulations regarding container placement
- Obtain any necessary permits or approvals
- Not use containers for illegal purposes or to store hazardous materials
- Maintain the container in a safe condition
- Not modify or alter containers without written consent (where modifications may affect structural integrity)
10. Prohibited Uses
You may not use our containers or website for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services. Prohibited activities include, but are not limited to:
- Storing hazardous, flammable, explosive, or toxic materials
- Storing illegal substances or contraband
- Modifying containers in ways that compromise structural integrity
- Using containers as living or sleeping quarters (unless specifically designed and approved for such use)

14. Dispute Resolution
If a dispute arises between you and Aussie General Freight, we encourage you to contact us first to seek a resolution. If we cannot resolve the dispute through informal discussions, both parties agree to participate in mediation in good faith before commencing any legal proceedings. The mediation will be conducted in Sydney, New South Wales, with a mediator agreed upon by both parties.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
16. Entire Agreement
These Terms, together with our Privacy Policy and any order confirmations, constitute the entire agreement between you and Aussie General Freight regarding the use of our website and the purchase of containers, superseding any prior agreements or understandings.
