Terms and Conditions

Welcome to Aussie General Freight. These Terms and Conditions govern your use of our website and the purchase of shipping containers from us. By accessing or using our services, you agree to be bound by these terms. Please read them carefully.

✔️ Australian Consumer Law applies: Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy provided under the Competition and Consumer Act 2010 (Cth) that cannot be excluded.

1. Definitions

In these Terms:

  • “Company”, “we”, “us”, “our” means Aussie General Freight Pty Ltd (ABN 98 765 432 109).
  • “Customer”, “you”, “your” means the individual or entity purchasing containers or using this website.
  • “Container” means any new, used, modified or specially adapted shipping container offered for sale.
  • “Website” means aussiegeneralfreight.au and all its subpages.
  • “Consumer” has the meaning given in section 3 of the ACL.

2. About Aussie General Freight

We are a family-owned Australian company specialising in the sale and delivery of shipping containers. Our registered office is Unit 17, 45 Industrial Circuit, Western Sydney, NSW 2148. For any queries, see our contact details at the end of this document.

3. Acceptance and Changes

By placing an order or using this website, you acknowledge that you have read, understood and agreed to these Terms. We may update these Terms from time to time. The current version will always be posted on this page with the “last updated” date. Continued use of our services after changes constitutes acceptance of the revised Terms.

4. Listings, Pricing & Payment

4.1 Accuracy

We take care to describe containers accurately (including grade, dimensions, condition). However, due to the nature of used containers, minor cosmetic variations may exist. Images are for illustration only.

4.2 Prices and GST

All prices displayed are in Australian dollars and include Goods and Services Tax (GST) unless stated otherwise. A tax invoice will be provided upon request.

4.3 Payment

We accept Visa, Mastercard, American Express, direct bank transfer, and EFTPOS (in person). Full payment is required before delivery or collection, unless a deposit arrangement has been agreed in writing.

5. Order Process

Your order constitutes an offer to purchase. We will send an acknowledgement email, but a binding contract is only formed when we send you an order confirmation (acceptance) or when the container is dispatched. If we cannot accept your order (e.g. stock unavailable), we will notify you and refund any payment.

6. Delivery and Collection

6.1 Delivery responsibilities

You are responsible for ensuring the delivery site has adequate access (width, height, ground condition). We will provide standard delivery dimensions upon request. If a delivery attempt fails due to inadequate access or incorrect information, redelivery fees may apply.

6.2 Risk and title

Risk in the container passes to you upon delivery or collection. Title remains with us until full payment is received.

6.3 Collection

If you choose to collect from our depot, you must do so within 7 days of payment. Storage fees may be charged thereafter.

7. Inspection and Acceptance

⚠️ Inspect before signing — You (or your representative) must inspect the container upon delivery or collection. Note any damage or discrepancy on the delivery docket. Failure to do so may limit your ability to make a claim later.

By signing the delivery receipt, you confirm that the container is in acceptable condition (except for any items specifically recorded).

8. Warranties and Returns

8.1 Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the ACL. For major failures, you are entitled to a replacement or refund and compensation for other foreseeable loss. For minor failures, you are entitled to have the failure rectified in a reasonable time.

8.2 Commercial / Non‑consumer purchases

If you are not a consumer (e.g. business purchase), our liability is limited to the maximum extent permitted by law, and any implied warranties are excluded. In that case, our warranty is limited to defects in materials or workmanship for:

8.3 Exclusions

Warranty does not cover normal wear and tear, surface rust on cut edges, damage from relocation, misuse, or force majeure.

9. Limitation of Liability

To the extent permitted by law, Aussie General Freight excludes liability for indirect or consequential loss (including loss of contents, profits or business interruption). Where liability cannot be excluded, our maximum liability is limited to the amount you paid for the container.

10. Customer Responsibilities

  • Obtain any permits or approvals required for container placement.
  • Not store hazardous, flammable, toxic or illegal substances.
  • Not use containers as habitable structures unless specifically sold as such and compliant with local laws.
  • Provide true and complete information when ordering.

11. Prohibited Uses

You must not use our website or containers for any unlawful purpose, or in any way that could damage our reputation or impair others’ use.

12. Intellectual Property

All content on this website (text, logos, images) is owned by or licensed to Aussie General Freight. You may not reproduce or distribute any material without written permission.

13. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using our site, you consent to such collection and use.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW.

15. Dispute Resolution

If a dispute arises, we encourage you to contact us directly. If not resolved, both parties agree to participate in mediation in Sydney before commencing court proceedings.

16. Severability

If any part of these Terms is held invalid or unenforceable, the remainder shall continue in full force.
